AzamPay provides comprehensive payment infrastructure services including:
• Payment Services: Processing of payments through multiple channels including mobile money, bank transfers, and card processing
• Management Services: Payment collection, disbursement, and reconciliation services
• Software and Applications: Digital solutions for payment management and integration with existing business systems
• Value-Added Services: Advanced features including virtual wallets, escrow services, salary advances, and embedded financing solutions
All services are subject to availability and may be modified, suspended, or discontinued at our discretion.
3. User Obligations
You agree to:
• Provide accurate, current, and complete information when registering for or using our services
• Maintain the security and confidentiality of your account credentials and API keys
• Comply with all applicable laws, regulations, and industry standards in your use of our services
• Not use our services for any illegal, fraudulent, or unauthorized purposes
• Not attempt to gain unauthorized access to our systems or interfere with the operation of our services
• Not reverse engineer, decompile, or disassemble any software provided by AzamPay
• Immediately notify us of any unauthorized use of your account or any security breach
• Ensure that all transactions processed through our platform comply with applicable anti-money laundering and know-your-customer regulations
4. Data Privacy and Security
We are committed to protecting your privacy and personal information. Our collection, use, and protection of data is governed by our Privacy Policy, which forms part of these Terms and Conditions.
We implement industry-standard security measures to protect your data, including:
• Encryption of data in transit and at rest
• PCI DSS compliance for card payment processing
• Regular security audits and assessments
• Access controls and authentication mechanisms
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
We may collect, use, and share transaction data as necessary to provide our services, comply with legal obligations, and prevent fraud.
5. Intellectual Property
All content, trademarks, logos, software, and intellectual property on the AzamPay website and platform are owned by AzamPay Tanzania Limited or our licensors.
You are granted a limited, non-exclusive, non-transferable license to use our services for your business operations in accordance with these terms.
You may not:
• Copy, modify, distribute, or create derivative works of our software or content without written permission
• Use our trademarks, logos, or branding without prior written consent
• Remove or alter any copyright, trademark, or proprietary notices

Any feedback, suggestions, or ideas you provide regarding our services may be used by us without obligation or compensation.
6. Fees and Payment Terms
Service fees are as specified in your service agreement or as published on our pricing page. Fees may vary based on transaction volume, payment method, and service tier.
You are responsible for all fees associated with your use of our services, including transaction fees, monthly subscriptions, and any applicable setup fees.
Fees are typically deducted from transaction proceeds or charged to your designated payment method. We reserve the right to change our fee structure with reasonable notice.
Refunds, if applicable, will be processed according to our refund policy and applicable regulations.
You are responsible for any taxes, duties, or charges imposed by applicable authorities in relation to your use of our services.
7. Limitation of Liability
To the maximum extent permitted by law, AzamPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Loss of profits, revenue, data, or business opportunities
• Service interruptions or unavailability
• Errors or delays in transaction processing
• Third-party actions or failures
Our total liability for any claims arising from or related to our services shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim.
We do not guarantee uninterrupted or error-free service. We are not responsible for delays or failures resulting from factors beyond our reasonable control, including but not limited to network failures, third-party service disruptions, or regulatory actions.
You acknowledge that payment processing involves inherent risks and that we cannot guarantee the success of every transaction.
8. Indemnification
You agree to indemnify, defend, and hold harmless AzamPay, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
• Your use or misuse of our services
• Your violation of these Terms and Conditions
• Your violation of any applicable laws or regulations
• Your infringement of any third-party rights
• Any disputes between you and your customers or other third parties
This indemnification obligation will survive termination of your use of our services.
9. Account Suspension and Termination
We reserve the right to suspend or terminate your account and access to our services at any time, with or without notice, if:
• You violate these Terms and Conditions or any applicable laws
• You engage in fraudulent, illegal, or unauthorized activities
• You fail to pay fees when due

Before initiating formal legal proceedings, parties agree to attempt to resolve disputes through good faith negotiation.
If a dispute cannot be resolved through negotiation, it may be referred to mediation or arbitration as mutually agreed upon.
Notwithstanding the above, we reserve the right to seek injunctive relief or other equitable remedies in any court of competent jurisdiction to protect our intellectual property or prevent unauthorized use of our services.
12. General Provisions
These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and AzamPay regarding the use of our services.
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these terms does not constitute a waiver of such right or provision.
You may not assign or transfer these terms or your rights hereunder without our prior written consent.
